Juvenile Justice - Hon’ble Supreme Court of India - Judgment

On the intervenor's Petition filed by Prayas JAC Society and Others contesting the Petition(s) filed by Mr. Subramanium Swami & Others, the Hon'ble Supreme Court of India have passed the attached (Below) judgment on 28th March 2014, in a historic judgment, the Hon’ble Supreme Court of India have accepted the contentions of the child rights activists, organizations and the MWCD, Govt. of India. The Hon’ble Court have gone into the minute details of the Juvenile Justice System as it operates in different countries of the world and also as it operates in India through the Juvenile Justice (Care & Protection of Children) Act, 2000/2006. The Hon’ble Court have decided not to intervene or read down any provisions of the Act, as demanded by Mr. Swami and several other petitioners. Most of the contentions earlier put up before the Hon’ble Court in Salil Bali case and before Hon’ble Justice Verma Committee by Prayas and others, have also been accepted.

The Hon’ble Court have found the age of 18 years for child/juvenile, the various provisions of the JJ Act and the differential treatment given to the children/juveniles in accordance with the international instruments like UNCRC and Beijing Rules etc. and the Constitutional Provisions, as fully compliant in the law. The Court have also gone into the much talked-about Juvenile Crimes and the Juvenile Justice System in India and other countries and found no justification to interfere with the present law and the procedure laid down under the principles of the JJ System.
